É um fato que a pandemia do COVID19 serviu como catalisadora do trabalho remoto.
Nesse contexto, as empresas foram obrigadas a se adaptar à nova realidade e, consequentemente, a dúvida de como fazer o controle de ponto dos funcionários à distância, de forma a resguardar o empregador de possíveis ações trabalhistas, atingiu diversos gestores e departamentos de rh.
Entretanto, a insegurança jurídica em relação ao Controle de ponto, seja no sistema remoto, seja no presencial, não teve sua origem na pandemia, ela sempre esteve presente no setor empresarial brasileiro.
Tal circunstância deve-se à construção da legislação trabalhista, a qual abre brechas interpretativas, não garantindo clareza a empresas, empregados e agentes jurídico, apresentando várias incoerências de aplicabilidade, principalmente nos tópicos sobre equipamentos de relógio de ponto.
Além de toda essa tensão jurídica, o ato de usar equipamentos biométricos que precisam do contato dos funcionários, passou a ser proibido, em vista de como o vírus da COVID19 é transmitido.
Assim, não havia outra saída, senão a modernização dos controles de jornada para sistemas via aplicativo.
Depois de algumas discussões e assembleias, a antiga legislação do Ponto Eletrônico foi substituída pela Nova Portaria 671/ 21, a qual cancelou todas as portarias anteriores e flexibilizou meios de registro eletrônico, prevendo novas categorias, sem proibições que representem o cerceamento de evolução tecnológica.
